These Terms of Service ("Terms") are a legal agreement between you and Fullancia, LLC, a Maryland limited liability company doing business as Find a Hypnotherapist ("Find a Hypnotherapist," "we," "us," or "our"). They govern your use of the website located at findahypnotherapist.io, any subdomain we operate, and any related services, features, or content we offer (together, the "Service").
By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who We Are and What We Do
Find a Hypnotherapist is a consumer directory that helps people find hypnotherapy practitioners. We publish practitioner profiles, allow practitioners to claim and manage their listings, and forward consultation requests from prospective clients to the practitioners listed on the directory. We do not provide hypnotherapy, medical advice, mental health treatment, or any other professional service. Practitioners listed on the directory are independent providers and are not our employees, agents, or partners.
2. Not Medical, Psychological, or Clinical Advice
The Service and all content on the directory are provided for informational purposes only. Nothing on the Service is a substitute for professional medical, psychological, or clinical advice, diagnosis, or treatment. If you are experiencing a medical or mental health emergency, call 911 or your local emergency number, or contact the 988 Suicide and Crisis Lifeline by dialing 988.
We do not verify the credentials, training, certifications, licensure, or competence of every practitioner listed on the directory beyond the claim verification process described in Section 4. You are responsible for vetting any practitioner you choose to contact or engage. Your relationship with any practitioner is between you and that practitioner.
3. Users and Accounts
The Service is intended for adults. By using the Service you confirm that you are at least 18 years old.
Prospective clients do not create accounts. You can search the directory and submit a consultation or contact form without registering. By submitting a form, you provide the information you chose to include and you agree to these Terms.
Practitioners and our staff create accounts to claim listings, manage profiles, receive consultation requests, and administer the Service. Practitioners must provide accurate information, keep their password secure, and promptly notify us at help@findahypnotherapist.io if they believe their account has been compromised. Practitioners are responsible for all activity that occurs under their account.
4. Practitioner Listings and Claim Verification
We create practitioner profiles from publicly available sources. A practitioner can claim a profile and enter one of our tiers (Free, Preferred, or Platform). We verify claims using one of the following methods: (a) auto-verification when the registration email matches the email on the scraped profile, (b) a six-digit code sent to the practice email on file, or (c) manual administrator review when email verification is not available.
If you are a practitioner, you represent that you are the owner or an authorized representative of the practice you are claiming, that you hold all licenses, certifications, and permissions required to offer hypnotherapy services in your jurisdiction, that the information you provide is accurate, and that you will keep your profile current. We can remove, suspend, or reassign a profile at any time if we reasonably believe the claim is invalid or that the practitioner has violated these Terms.
5. Paid Tiers, Billing, and Automatic Renewal
Preferred ($49 per month) and other paid features are billed through our third-party payment processor. All fees are quoted in U.S. dollars, are exclusive of taxes, and are non-refundable except where required by law.
AUTOMATIC RENEWAL NOTICE: Paid subscriptions automatically renew at the end of each billing cycle (monthly or annual, as selected) at the then-current rate. By subscribing, you authorize Fullancia, LLC and its payment processor to charge your payment method on a recurring basis until you cancel. The current price and billing cycle are shown to you before checkout and in your account. You can cancel at any time from your account settings under "Billing" or by emailing help@findahypnotherapist.io at least one (1) day before the next renewal date. Cancellation stops future billing; it does not refund fees already charged, and you keep access until the end of the paid period. If a payment fails, we can suspend paid features until the account is brought current. For annual subscriptions, we will send a renewal reminder by email before each renewal. California, Oregon, New York, Illinois, Vermont, and District of Columbia residents have additional rights under applicable automatic-renewal laws, which we honor.
We can change pricing, plan features, or plan names by posting an update or notifying you in your account. Material changes apply no sooner than the next billing cycle, and you can cancel before the change takes effect.
6. Consultation Requests and Prospect Communications
The Service lets prospective clients send consultation requests to practitioners. By submitting a request, you authorize us to share the information you provide with the practitioner you selected. We may also send you follow-up emails that include alternative practitioners who are actively accepting consultations, nurture content related to hypnotherapy, and occasional updates about the Service.
Practitioners who receive consultation requests agree to handle prospect information responsibly, to respond promptly or decline, and to comply with all applicable privacy, consumer protection, and anti-spam laws.
7. SMS and Email Communications (TCPA)
Find a Hypnotherapist sends text messages from a verified toll-free number registered to Fullancia, LLC under the carriers' Toll-Free Verification program. By providing a phone number to the Service, you give prior express consent to receive recurring automated and non-automated text messages and calls from Find a Hypnotherapist and, where applicable, from the practitioner you contact, including transactional notices, consultation confirmations, appointment reminders, and service updates. Message and data rates may apply. Consent to receive text messages is not a condition of purchase.
You can opt out of marketing text messages at any time by replying STOP to any message, and you can get help by replying HELP. Practitioners who send their own SMS through our separate platform product use their own registered A2P 10DLC brand and campaign and must comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, CTIA guidelines, and all other applicable laws. We can suspend SMS privileges for any practitioner who violates these requirements.
You can opt out of marketing emails using the unsubscribe link in any marketing email. We may still send transactional emails, such as password resets, consultation confirmations, and billing notices, even if you have opted out of marketing.
8. Acceptable Use
You agree not to: (a) use the Service to violate any law or the rights of any person, (b) misrepresent your identity or your practice, (c) scrape, crawl, or otherwise copy the directory for any purpose other than your own personal, non-commercial use, (d) interfere with the operation of the Service, reverse engineer any part of it, or attempt to bypass rate limits or access controls, (e) upload viruses, malware, or harmful code, (f) send unsolicited commercial messages, (g) use the Service to harass, defame, or discriminate against any person, or (h) use the Service to provide, request, or arrange emergency care.
We can suspend or terminate access for any violation.
9. User Content and Third Party Content
If you submit content such as reviews, profile text, photos, consultation messages, or other materials ("User Content"), you keep ownership of that content. You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, reproduce, display, distribute, and create derivative works of your User Content for the purpose of operating and promoting the Service.
You represent that you have the rights to grant that license, that your User Content does not infringe any third party rights, and that it is not false, defamatory, or unlawful. We can remove any User Content at our discretion, and we can edit or refuse to publish User Content.
The Service is an interactive computer service under Section 230 of the Communications Decency Act, 47 U.S.C. § 230. We are not the publisher or speaker of any content submitted by practitioners, prospects, or other third parties, including information carried over from public sources into unclaimed profiles. We do not guarantee the accuracy of practitioner-submitted information. If you believe content on the Service is inaccurate, please contact info@findahypnotherapist.io so we can investigate and, if appropriate, correct or remove it.
10. Intellectual Property
The Service, including the name "Find a Hypnotherapist," our logos, site design, code, databases, and directory arrangement, is owned by Fullancia, LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in these Terms, we reserve all rights. You may not use our trademarks without our prior written permission.
10.5 Badge Program
Find a Hypnotherapist displays the following badges on practitioner profiles:
"Verified" means the practitioner confirmed ownership of the listing by claiming the profile and passing our email-based verification process, or by manual administrator review. It does not mean we verified licenses, certifications, training, or clinical competence.
"Preferred" means the practitioner has a paid Preferred-tier subscription and has enabled a consultation calendar through the Service. It is a status earned by subscription and activation, not an endorsement of clinical quality.
"Partner" means the practitioner subscribes to our Platform tier and runs practice operations on our separate platform service. It is a status earned by subscription, not an endorsement of clinical quality.
Prospective clients should independently verify any practitioner's credentials, license status, and fitness for their needs. We do not guarantee the outcome of any consultation, treatment, or recommendation. Practitioners must not represent that a badge signifies our endorsement of their clinical services or any specific result.
11. Third Party Services and Links
The Service uses and links to third party services, including payment processors, email and SMS providers, analytics providers, calendar providers, and external practitioner websites. We are not responsible for the content, practices, or policies of any third party. Your use of a third party service is governed by that provider's own terms and privacy policy.
Calendar integrations. Practitioners can connect Google Calendar or Microsoft Outlook calendars to the Service through OAuth. When you connect a calendar, you authorize us to check your free/busy status so prospective clients can see when you are available, and to create calendar events when consultations are booked. Your calendar data is governed by Google's and Microsoft's own terms and privacy policies. You can disconnect a calendar at any time from your account settings. Disconnecting revokes our access and deletes the stored credentials. We are not responsible for outages, changes, or data handling by Google or Microsoft.
12. DMCA / Copyright Notices
If you believe content on the Service infringes your copyright, please send a notice with the information required by 17 U.S.C. § 512(c)(3) to info@findahypnotherapist.io. We will respond consistent with the Digital Millennium Copyright Act.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, FULLANCIA, LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, ERROR-FREE, OR SECURE, OR THAT ANY LISTED PRACTITIONER IS QUALIFIED, LICENSED, OR APPROPRIATE FOR YOUR NEEDS.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FULLANCIA, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.
15. Indemnification
You agree to defend, indemnify, and hold harmless Fullancia, LLC and its affiliates, officers, members, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, your violation of any law, or your interaction with any practitioner or prospect.
16. Termination
You can stop using the Service at any time. We can suspend or terminate your access at any time, with or without cause, with or without notice. Sections that by their nature should survive termination will survive, including Sections 9, 10, 13, 14, 15, 17, and 18.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Maryland, without regard to conflict of laws principles.
Informal resolution first. Before filing any claim, both parties agree to try to resolve the dispute informally for thirty (30) days by sending a written notice describing the claim to the other party at the addresses in the final "Contact Us" section, and working in good faith to reach a resolution.
Non-binding mediation. If the dispute is not resolved informally, both parties agree to attempt non-binding mediation in Maryland before a mutually selected mediator (or, if the parties cannot agree, a mediator appointed by the American Arbitration Association under its Commercial Mediation Procedures). Each party bears its own fees and shares the mediator's fees equally. Mediation must be attempted in good faith for at least one full session or sixty (60) days, whichever is shorter.
Courts. If the dispute is not resolved through informal resolution or mediation, either party may bring the dispute exclusively in the state or federal courts located in Maryland, and each party consents to the jurisdiction and venue of those courts. You and Fullancia, LLC each waive any right to a jury trial. Any claim must be brought within one (1) year after it arises or it is permanently barred. Nothing in this section prevents either party from seeking injunctive or equitable relief in court at any time to protect its intellectual property or confidential information.
18. Changes to These Terms
We can update these Terms from time to time. If we make material changes, we will post the updated Terms with a new "Last updated" date and, where appropriate, notify you by email or in the Service. Your continued use after the effective date means you accept the updated Terms.
19. Accessibility
We want the Service to be usable by everyone. We work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you have trouble accessing any part of the Service, or if you have accessibility feedback, please contact help@findahypnotherapist.io and we will work with you to provide the information or service through an accessible means.
